Wireless Industry Now Seeks to Limit Local Control at Federal Level
On November 29, 2017, the City of Palos Verdes Estates sent a letter to U.S. Senators' Dianne Feinstein and Kamala Harris urging their opposition to a draft bill that is currently circulating the Senate Commerce Committee. Similar to SB 649, which was recently vetoed by Governor Brown, the bill being circulated by the wireless industry seeks to:
- Force local governments to lease out publicly owned infrastructure;
- Eliminate reasonable local environmental design and review;
- Eliminate the ability of local governments to negotiate fair leases or public benefits for the installation of "small cell" wireless equipment on taxpayer-funded property.
Ultimately, the elements contained in this bill, such as the elimination of lease agreements and reduced of timelines for permit approval, are worse than the recently failed SB 649.
